Why have you been asked to attend an Interview Under Caution?

There are various explanations as to why you might have been asked to attend an interview under caution. HMRC may have reasons to believe that you have committed a crime, such as:

  • Money laundering.
  • Tax fraud or tax evasion.
  • Illegal importation or exportation of goods.
  • Making false financial statements.
  • Taxation fraud related to crime or organised crime.

It is important to note that being invited for interview does not mean that you are guilty, it does however mean that HMRC have questions to ask you based upon information that they have gathered.

If you receive a request to attend an interview under caution by HMRC, do not ignore it. Attending a HMRC Interview Under Caution

It is always good practice to seek legal advice, even if you believe that you have done nothing wrong. When you have the benefit of legal advice at your interview, the investigators will provide our representative with ‘disclosure’ outlining the reasons they wish to interview you. You will then have the opportunity to discuss this in private with your solicitor prior to the interview, it will allow you to understand how the investigators think you have committed a crime, and discuss any information or evidence that contradicts this.  

What happens after attending a HMRC Interview Under Caution

Once an interview under caution has been conducted, and all evidence has been gathered, this could include a further interview at a later date, a decision maker will review it and decide whether the case should be prosecuted. We can make representations to HMRC on this issue and, where you admit the matter, try to push for a disposal that doesn’t involve you going to court.

If you are prosecuted and are required to attend Court you must contact us straight away to arrange an appointment before the Court hearing. We will thoroughly prepare your defence and attend all of the hearings with you.
