6. Deposit Disputes

Even where a tenancy ends amicably, arguments can arise in relation to what is going to happen with any deposit?

The first question is whether or not the landlord has protected the deposit. Any monies paid towards a deposit must be protected within 30 days of receipt. If the landlord hasn’t done this then they will likely have to repay the full amount of the deposit and compensation.

Most deposit protection schemes have an adjudication scheme whereby they will attempt to settle disputes between the parties as to who should receive what from the deposit. This should always be the first port of call and our advisors can help you put your best foot forward in the negotiations.

The adjudication scheme is not binding and if you disagree with the outcome our representatives will advise you as to your options to recover the monies owed to you.
