2. Problems during a Tenancy

Despite our best intentions, not everything goes as smoothly as we may like.

Problems can arise throughout the life of the tenancy and in many cases, it is better to attempt to resolve these issues.

Not paying Rent is probably the first thing you think of when considering problems during a tenancy. Rent Arrears can accrue for a number of reasons, such as a dispute between the parties or the tenants falling on hard times. In most situations, tenants should not withhold rent from a landlord though there are certain circumstances where this is permitted.

Often, the state of the property itself can cause a dispute between landlords and their tenants. Perhaps the tenants are not taking proper care of the property and allowing it to fall into a poor state. Or maybe there are long standing issues that have been reported by the tenants and the landlord has failed to undertake repairs.

The behaviour of either party can also cause a lot a friction and this can worsen if a dispute has arisen. Landlords should not attempt to use threatening or harassment tactics to try and encourage a tenant to vacate. Nor should they simply turn up to a property unannounced and without proper notice. Equally, a tenant should ensure that they are not causing a nuisance to neighbouring properties or acting inappropriately towards their landlord.
