3. The End of the Tenancy
All things come to an end and the same is true for tenancies.
Often, tenancies come to an end because one party or the other is moving on to pastures new. In these situations we can advise you as to what steps you need to take to bring an end to the tenancy based on your tenancy agreement and particular circumstances.
In most cases, where the fixed term of the tenancy has ended, you can simply provide notice to the other party that you wish to bring the agreement to an end (though for Landlords this must be on a specific form, see Possession [LINK] below).
During the fixed term, however, things are a bit trickier and a tenancy can only be brought to an end by agreement between the parties or by use of a “break clause”.
Rarely, a tenant may simply leave the property, without ending the tenancy properly. This is called Abandonment. Landlords should tread carefully where they believe a tenant has abandoned a property to avoid an unintentional unlawful eviction (see Unlawful Eviction [LINK] below). For Tenants, abandoning a tenancy can make it harder for you to find a new home in the future.
