Debts owed by the estate
One of the primary duties of an Executor is to ensure that all estate debts are fully discharged before accounting to beneficiaries.
Most of these are straightforward such as ensuring that anything owed to utility companies is paid out of the estate’s assets before any residue is distributed to the beneficiaries. However, sometimes on behalf of the estate an Executor may wish to challenge an invoice allegedly owed.
Alternatively, a creditor may be seeking to pursue an estate for sums owed.
All are wise to take legal advice upon the specific circumstances of any claim made against the estate at the earliest opportunity and before taking any action that might compromise their positions in any later litigation.
