Executor & Personal Representative Disputes

Disputes between those involved in the administration of an estate often arise out of a lack of clear open communication or differing opinions about what should happen with certain assets.

Executors and Trustees should generally try to administer an estate to the best of their ability but sometimes problems can arise requiring decisions to be made that are not always popular with beneficiaries. When there is a difficult decision to be made, Executors and Trustees ought to take professional advice to protect their position.

Beneficiaries generally wish for the estate to be administered properly and to receive their inheritance as quickly as possible. Beneficiaries often become concerned about an estate when they are not kept informed by the Executor, which leads to ill feeling and distrust.

Beneficiaries who are not being kept informed or are concerned about what is happening with an estate’s assets should seek legal advice on their position and the options available to them in their specific circumstances.
