New legislation on making Wills

During the coronavirus pandemic, there has been an increasing number of individuals who have sought to make Wills. Throughout the pandemic our dedicated team have remained fully operational, ensuring we continue to offer our services to clients by means of telephone communication and video conferencing.

Consequences brought on by COVID-19 have led to changes in legislation in regards to making Wills. Currently, 2 witnesses must be present in order for a Will to be considered legally binding. However, new legislation that is set to be introduced in September means that witnesses can be present either physically or by means of virtual platforms such as Zoom and Skype.

How long will the new legislation be in place?

The new measures regarding virtual Will witnessing will be backdated to 31st January 2020. This means that any Wills that have been witnessed virtually since this time will be considered legal. The temporary change of legislation will be in place until 31st January 2022, or as long as it is deemed necessary.

How does virtual Will witnessing work?

Witnesses must see a Will being signed in real time, so pre-recorded videos cannot be used in this instance. When witnessing a Will being signed virtually it is vital that the quality of the video and sound high enough to fully witness a Will signing.
