What is a financial settlement?

Financial settlements can often become a large part of a separation or divorce. The purpose of a financial settlement allows separating couples to agree on the division of their finances and assets. Such agreements allow separating couples to make arrangements on a range of issues, including:

  • Property divisions
  • Money, shares, savings and investments
  • Division of debt and pensions
  • Lump-sum payments
  • Children / spousal maintenance
  • Personal Belongings, e.g. pets, cars


When should you agree to a financial settlement?

Our team appreciate that when a relationship breaks down this can be an overwhelming time and added pressures of dividing assets between you and your ex partner can add to the distress.
Once you have decided that divorce or separation is the inevitable option, it is highly recommended that you seek independent legal advice as soon as possible. This will allow for both parties to come to an agreement regarding their assets and finances before they apply for their decree absolute.

Why is it advised to seek advice regarding financial settlements?

In England and Wales, even after a divorce, ex-spouses still retain the ability to make financial claims, where there is no time limit for such claims to be made.
The benefit of obtaining a legally binding agreement regarding assets and finances means that this would prevent any future claims being made which could cause further distress, years after a divorce has been finalised.
