What is a Prohibited Steps Order?

A Prohibited Steps Order is a Court Order which prohibits a party (normally a parent) from making certain decisions about their child’s upbringing. Such orders can prevent activities, including:


  • The parent moving a child from the school or nursery.
  • The child or children coming into contact with another individual (such as their new partner).
  • The parent moving the child to a location outside of the UK, or even away their current local area.
  • Changing the child’s last name.
  • A parent allowing the child to undergo a medical treatment which is deemed a high risk.


How long does a Prohibited Steps Order last?

Normally, a Prohibited Steps Order would last until a child turns 16 years of age. However, such orders can be set for a dedicated length of time, and in certain circumstances, a Prohibited Steps order can be set until a child turns 18.


When to apply for a Prohibited Steps Order?

There are a number of reasons as to why a parent may wish to apply for a Prohibited Steps Order. For example, a former partner may be threatening to carry out an activity that may not be in the child’s best interests, such as moving them away.

It is important to note that the Court will only grant a Prohibited Steps Order if it feels it is in the child’s best interests.
