What is assault?

Assault is considered to be the act of inflicting physical harm, or unwanted physical contact upon an individual. On some occasions a threat, or an attempt to commit such an act can be considered assault and will require legal representation.


What types of assault are there?

There are numerous recognised assault charges, dependent on the severity of the charge, will depend on the penalty received by the accused. It is vital that you seek legal advice if you have been alleged to have committed:

  • Common assault: This is considered to be any violence that is inflicted upon another individual (however minor this may be), or making someone else feel intimidated, as though they are going to be attacked. For example, making violent threats, raising a fist to someone, or even spitting on an individual.
  • Actual bodily harm (ABH): ABH is an act which must have caused some physical harm to the victim. This doesn’t necessarily have to be a serious or permanent injury, however, a physical injury must have existed briefly.
  • Wounding/grievous bodily harm (GBH): GBH is considered to be really serious physical harm inflicted on an individual, however, it doesn’t have to be permanent. GBH can also encompass any psychiatric injury, or an individual transmitting an infection (e.g. through sexual activity). When wounding is concerned, this means that skin must have been broken during the assault, or breaking of the inner skin (e.g. in the lip).

The types of assault charges are complex, which is why it is important to seek independent legal advice as soon as you have been charged.

When you have been charged with assault, this can be very serious. Dependent on the severity of the case, will depend on how you are prosecuted and furthermore, the penalty you will receive.
