What are Health and Welfare LPAs?

Making a Health & Welfare LPA is a way to plan ahead in case you lose the capacity to make decisions yourself. It involves assigning someone you trust (usually a family member or friend) to act on your behalf when you cannot do so. Health and Welfare Attorneys make decisions regarding your personal welfare. This could include:

  • Daily routine (e.g. washing, dressing and eating)
  • Medical care
  • Where you live


Why are Health and Welfare Attorneys important?

Without having a LPA in place there are a number of things that could happen:

  • Where you live and what care you require – If you don’t appoint an attorney, Social Services may become involved in order to make decisions about where you live and the care you require.
  • Decisions about your Health and Welfare – these could made without your wishes being taken into consideration, only your legal next of kin would be consulted (who you may not wish you be your LPA). Decisions could be made about matters –such as resuscitation – without knowledge of your own wishes.

Making a Lasting Power of Attorney doesn’t mean you are giving up the control of your own health and welfare, it enables someone to speak on your behalf when you have lost capacity to do so and the powers only begin when you have lost capacity to make decisions yourself.
