What is a Financial LPA?

There might come a point in your life where you feel as though you need some help with the day-to-day management of your property and financial affairs.

To ensure that whoever is looking after your property and financial affairs are the people you trust and who understand your wishes, you can appoint them as your Attorneys under a Lasting Power of Attorney.

Appointing somebody you can trust to be your Property and Financial Affairs Attorney will allow them to make (or help you make) decisions regarding financial affairs, such as:

  • Money, tax and bills
  • Bank and Building Society accounts
  • Property and Investments
  • Pensions and benefits

A financial LPA will also have the ability to use your money in order to look after you home and buy anything you need to live your day-to-day life (e.g. food).


Why are Financial Affairs Attorneys important?

Assigning someone to look after your finances isn’t just for your own benefit. If you were to lose capacity – be it suddenly or gradually – your family or business partners might worry that matters relating to your property and financial affairs might simply come to a halt.

With an LPA in place, your family and/or business partners will have the comfort in knowing that you have appointed an Attorney to make the decisions on your behalf. You don’t need to lose the capacity to make decisions for yourself for an Attorney to make decisions, if you provide permission.

Once you have lost capacity you cannot put an LPA place. In these circumstances, it’s a lot more complex and expensive as you’ll have to make an application to the Court of Protection.
